These Terms govern your use of TunnelVision (the "App") for macOS and iOS, and any related services provided by Josiah ("we," "our," "Licensor"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved.
2. Open Source
The source code for the App is available under the MIT License. Nothing in these Terms restricts your rights under that license. The compiled binaries distributed through the App Store may include additional terms required by Apple.
3. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Reverse engineer, decompile, or disassemble the App (except to the extent permitted by the open-source license).
- Use the App to monitor or control systems you do not own or have explicit authorization to access.
- Circumvent or disable any security or encryption features of the App or its relay infrastructure.
- Redistribute, sell, lease, or sublicense the App or any derivative works.
4. Relay
The App communicates through a relay to deliver encrypted server state between your devices. We use this relay for the sole purpose of message delivery. We do not log, inspect, or store the contents of relayed messages. You are responsible for deploying and securing your own relay instance if you self-host.
5. Privacy
Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
6. No Warranty
The App is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, secure, or error-free.
7. Limitation of Liability
In no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, even if advised of the possibility of such damages. The total liability of the Licensor shall not exceed the amount you paid for the App (if any).
8. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, you must cease all use of the App and delete all copies.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
